CFTC Chairman: ETH 2.0 uses the PoS mechanism or makes Ethereum a security

According to the Bitcoin Exchange Guide, Heath Tarbert, chairman of the US Commodity Futures Trading Commission (CFTC), said recently that mining is a more decentralized way to obtain cryptocurrencies, but the nature of the Ethereum tokens may change. Since ETH 2.0 will use the Proof of Entitlement (PoS) to support Staking, holders can continue to benefit from the network. Equity tokens may not pass the Howey test (testing whether it is a test of securities) under certain factors, and this will be considered a security. Heath Tarbert has previously stated that ETH is not a security, but a commodity and therefore falls under the jurisdiction of the CFTC.
