Clearview AI Prevails in UK Court GDPR Appeal for US Surveillance and Facial Recognition

U.S. surveillance and facial recognition firm Clearview AI recently had a court victory in the United Kingdom, and boy oh boy, it’s got everyone talking! You see, they were accused of breaching the U.K.’s general data protection regulation (GDPR), and faced a hefty fine of nearly $10 million. But Clearview AI won the appeal, and now that fine might just be history, unless the Information Commissioner’s Office (ICO) decides to shake things up with another appeal.

According to Tribunal Judge Lynn Griffin, whether Clearview AI violated the GDPR or not is not the main issue here. The real deal is whether the GDPR even applies to foreign companies like Clearview AI. It’s all about jurisdiction, my friends. As the court documents released on October 17th state, “Whether or not CV has infringed the Articles of GDPR or UK GDPR as alleged or at all was not the issue before us. That would be the subject of any substantive hearing were this case to go forward.”

So, in plain English, despite Clearview AI having billions of images in its facial recognition and surveillance system (which, experts say, include images from the U.K. sourced from “public” internet repositories), the U.K.’s ICO simply doesn’t have the power to enforce GDPR protection in this case.

The court document goes on to say that since Clearview AI is a foreign company serving foreign clients, using foreign IP addresses, all in support of national security and criminal law enforcement purposes, the U.K.’s GDPR jurisdiction doesn’t extend to them. It’s like trying to regulate a wild stallion that has galloped far away from the barn.

This precedent-setting victory of Clearview AI is quite the game-changer. It pretty much restricts the enforcement of GDPR to companies solely within the U.K.’s jurisdiction. But hold on, folks, because the plot thickens! Clearview AI has actually faced multiple lawsuits and fines in Europe, thanks to the EU’s GDPR. France, Italy, and Greece have all put a price tag on Clearview AI’s shenanigans. Even Sweden’s local police authority was fined over $300K for using Clearview AI’s products illegally in 2021. They clearly need some serious facial recognition of their own to wipe that smug grin off their faces.

But wait, there’s more! Clearview AI seems to have some magic tricks up its sleeve. Even though they were slapped with a massive $20 million fine in France for breaching the GDPR in October 2022, they simply refused to pay up. And guess what? In May 2023, they were found in breach of that order. It’s like trying to teach a bullfrog to sing opera. They just won’t follow the rules, will they?

Here’s where it gets even spicier. Clearview AI, with its controversial software and services, has managed to walk on a tightrope between civil rights and privacy protections. Some experts claim they’ve been floating above the law, despite the fact that their close ties with law enforcement should have made them bound by the same principles as the rest. It’s like being a unicorn in a paddock of horses. They’re special, apparently.

And that’s not all, my friends. If you think you can escape from Clearview AI’s clutches, think again. It’s nearly impossible to remove your data from their databases and systems. They’ve got their hooks in so deep that most people can’t even dream of getting out. According to Clearview AI’s Privacy Policy, only residents of certain states have a chance to submit a request to access, opt-out, or delete their information. It’s like being stuck in a twisted version of a state fair, where only folks from California, Colorado, Connecticut, Illinois, and Virginia get a shot at the ride.

If you’re one of those unlucky souls living outside those privileged states, well, tough luck! Clearview AI has made it clear that they may have sold your precious face vectors and photographs to law enforcement, government agencies, and other bigwigs in the security business. You’ve been caught in their web, my friend, and it’s not easy to break free.
