At present, China's digital economy is large in size, with a large user base, and the demand for digital dispute resolution is growing rapidly. At the same time, the development of blockchain technology and industry innovation, science and technology benefit from new creations, and the development of intelligent dispute resolution methods has gradually matured.
With the promulgation of multiple central government policies, digital transformation in the field of dispute resolution has risen to a national strategy. According to the "Several Opinions on Improving the Arbitration System and Increasing the Trustworthiness of Arbitration" issued by the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council, adapting to the development of the new economy and new formats such as the Internet, relying on Internet technology, establishing a networked case management system An arbitration platform connected to platforms such as Internet finance, researches and explores online arbitration, intelligent arbitration, and realizes online and offline coordinated development.

Highlight 1: Clarify the concept of online arbitration and overcome the lag in the transition period

There are many necessary offline operation links, which bring difficulties to the entire process of networked dispute resolution. After research, the “half online, half offline” situation of business groups in the market will continue for a long time due to the post-dispositional nature of dispute resolution.

Article 1 of the "Online Arbitration Rules" provides that these rules apply to contract disputes in which the signing or performance of the contract is partially or wholly completed on the Internet. In the era of the digital economy, the parties' needs for dispute resolution are more urgent. On the basis of protecting the rights of the parties, the "Online Arbitration Rules" focuses on highlighting the characteristics of efficient and flexible arbitration procedures. For example, the deadlines for defense, counterclaim, selection of arbitrators, and withdrawal of requests in the Online Arbitration Rules are appropriately shorter than those in the China Maritime Arbitration Commission Arbitration Rules.
According to Article 20 (1) of the Online Arbitration Rules, unless the parties agree otherwise or the arbitral tribunal decides otherwise, the arbitral tribunal shall conduct a written trial of the online arbitration case. The parties do not have to travel, and they can enjoy cost-effective and efficient dispute resolution services without leaving home.
In addition, Chapter 4 of the "Online Arbitration Rules" sets up a special chapter "Fast Procedural" to make the arbitration procedure truly "doubled". According to the provisions of this chapter, the expedited procedure may be applicable if the amount of dispute does not exceed 500,000 yuan, or the amount of dispute exceeds 500,000 yuan but is agreed by the parties or the written application of one party and the written consent of the other party are obtained. The time limit for arbitrators, arbitrators' challenge, defense, and counterclaims was shortened to 3, 3, 5, and 5 days after receiving the notice of arbitration, and the ruling was also shortened to 1 month, compared to ordinary online arbitration procedures. Highlight three: Clear electronic evidence identification, core technologies such as blockchain connectivity
Different from the traditional method of sending paper evidence offline, online arbitration evidence is mostly electronic evidence formed online, which is significantly different from traditional evidence in terms of storage, transmission, and identification. Aiming at the particularity of electronic evidence, China Haizhong specifically stipulates the identification of electronic data in Chapter III, Section IV of the Online Arbitration Rules. The arbitral tribunal will consider three aspects of the authenticity of electronic data, namely generation, storage Or the reliability of the method of transmitting electronic data, the reliability of the method of maintaining the integrity of the content, and the reliability of the method of identifying the sender.
The online arbitration platform adopts electronic signatures, trusted time stamps, hash value verification, blockchain and other evidence collection, fixation and tamper-resistant technical means, or through the requirements of the authentication and adaptation rules of electronic forensics and deposit platform authentication. "One-click transmission", the arbitral tribunal can "one-click identification" to achieve reliable and convenient electronic data identification function.
Highlight 4: Allow procedures to change to protect the needs of online arbitration cases
At present, the development of online dispute resolution mechanisms is not fully mature, and the experience that can be learned is not abundant. Considering that online arbitration will inevitably face new policies, new situations and new problems in the development process, in order to cover some currently unpredictable risks and difficulties In order to ensure the smooth progress of the arbitration process, after careful consideration, China Haizhongte specially created an online and offline procedure conversion mode in Chapter III of Chapter 6 of the "Online Arbitration Rules" in order to guarantee the arbitration procedure in the case that the dispute cannot be resolved online. It went smoothly and met the parties' existing expectations for dispute resolution.
According to Article 29 of the Online Arbitration Rules, the arbitral tribunal or the arbitration court of the Arbitration Commission has the right to change the arbitration procedure to offline mode in four cases and continue the arbitration procedure in accordance with the provisions of the Arbitration Rules. 1. The online arbitration procedure stipulated in these rules cannot be continued due to the reasons of the parties; 2. The parties have disputes over the authenticity of the evidence submitted in the form of electronic data, and the arbitral tribunal cannot determine it online; 3. The parties are in agreement Consent; 4. Other circumstances deemed necessary by the arbitral tribunal or arbitration commission.
